Kentucky Landlord Tenant Rights

Whether you are a landlord or a tenant, renting a home is a big decision. That’s why we’ve compiled a list of everything you need to know about Kentucky Landlord Tenant Rights.

Landlord Responsibilities

Landlords have certain responsibilities to tenants. These include addressing or providing the following:

  • Water
  • HVAC
  • Plumbing and sanitation
  • Electricity
  • Bed bugs

Landlords are prohibited from engaging in retaliatory conduct. Tenants may make repairs themselves and deduct the cost from any rent due, up to half the month’s rent or $100 whichever is greater.

Tenant Responsibilities

Under Kentucky law, tenants also have responsibilities to their landlords including:

  • Paying the rent in a timely manner
  • Keeping the unit clean and in good repair
  • Maintaining plumbing fixtures
  • Refraining from engaging in illegal activity
  • Not disturbing other tenants or neighbors
  • Not destroying any part of the unit
  • Complying with all building and housing codes that materially affect health and safety

Security Deposit

Landlords can ask for any amount for the security deposit. They must put the funds in a federally-regulated banking institution, but are not obligated to pay the tenant any accrued interest. The landlord must return the security deposit minus any missed payments, lease violations, or damages. The tenants have 60 days after receiving notice of deductions to claim their deposit; there is no set time period in which the landlord must return the deposit.

Rent and Fees

Landlords are able to charge any amount they choose for rent and can increase that amount at any time without prior notice to the tenant. Returned check fees are limited to $50.


Landlords can evict tenants in the following situations:

  • Nonpayment of rent
  • Violation of lease terms
  • No lease or end of lease

Tenants can legally end their lease early for the following reasons:

  • Active military duty
  • An uninhabitable unit
  • Landlord harassment

Landlords in Kentucky have a duty to mitigate damages by re-renting the premises.

Lease Termination Notice

If the lease is being terminated for nonpayment of rent, the tenant must be given a 7-day notice. For termination due to violation of lease terms, a 14-day notice is required. If the tenant has stayed in the unit past the end of the lease or there is no lease in place, they must be given a 7-day notice if their tenancy was week-to-week; a 30-day notice if month-to-month; and a 10-day notice if the lease is a fixed term.
